Terms and conditions of sale for products sold on Mon Adaptateur
Article 1: Purpose
These terms govern the sales made by the sole trader operating under the trade name BGD GROUP (hereinafter “BGD GROUP”), 22 rue Surcouf, 75007 Paris, France.
Article 2: Prices
Our product prices are shown in euros; VAT is not applicable under article 293 B of the French General Tax Code. Any handling and shipping costs are shown separately before the order is confirmed.
If you order for delivery to a country other than mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and sums are outside the responsibility of BGD GROUP. They are payable by you and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to check these points with your local authorities.
All orders, whatever their origin, are payable in euros.
BGD GROUP reserves the right to change its prices at any time, but the product will be invoiced at the price in force when the order is confirmed, subject to availability.
Products remain the property of BGD GROUP until the price has been paid in full.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
The contractual information is presented in French and will be confirmed at the latest when your order is confirmed.
BGD GROUP reserves the right not to record a payment and not to confirm an order for any reason whatsoever, in particular in the event of a supply problem or a difficulty with the order received.
Article 4: Confirmation of your order
Any order placed on the website https://mon-adaptateur.fr/ implies acceptance of these Terms and Conditions. Any order confirmation entails your full and complete acceptance of these terms and conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation will serve as proof of the transaction.
You declare that you are fully aware of them.
Order confirmation is equivalent to signature and acceptance of the transactions carried out.
A summary of your order details and of these Terms and Conditions will be sent to you as a PDF to the email address used to confirm your order.
Article 5: Payment
By confirming your order, you undertake to pay the price shown.
Your purchases are paid by bank card through the secure Paypal/Stripe system.
Your card is only debited when the order is dispatched. In the case of split deliveries, only the products dispatched are debited.
Article 6: Right of withdrawal
In accordance with article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal, without having to give reasons or pay any penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). You are responsible for this. Any damage to the product on this occasion may invalidate the right of withdrawal.
Return costs are payable by you.
If you exercise your right of withdrawal, BGD GROUP will refund the sums paid within 14 days of being notified of your request, using the same payment method as the one used for the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:
The supply of services fully performed before the end of the withdrawal period, where performance began with the consumer’s prior express consent and express waiver of the right of withdrawal.
The supply of goods or services whose price depends on fluctuations in the financial market beyond the trader’s control that may occur during the withdrawal period.
The supply of goods made to the consumer’s specifications or clearly personalised.
The supply of goods liable to deteriorate or expire rapidly.
The supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.
The supply of goods which, after delivery and by their nature, are inseparably mixed with other items;
The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed when the contract was concluded depends on market fluctuations beyond the trader’s control.
The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
The supply of a newspaper, periodical or magazine, except for subscription contracts for these publications.
Transactions concluded at a public auction.
The supply of digital content not supplied on a tangible medium, where performance began with the consumer’s prior express consent and express waiver of the right of withdrawal.
Article 7: Availability
Our products are offered for as long as they are visible on the website https://mon-adaptateur.fr/ and while stocks last. For products not held in stock, our offers are valid subject to availability from our suppliers.
If a product becomes unavailable after you have placed your order, we will inform you by email. Your order will be cancelled automatically and no payment will be taken.
In addition, the website https://mon-adaptateur.fr/ is not intended to sell its products in large quantities. Consequently, BGD GROUP reserves the right to refuse orders for identical items.
Article 8: Delivery
Products are delivered to the delivery address given during the ordering process, within the time shown on the order confirmation page.
Current shipping rates:
Mainland France and Europe (including the United Kingdom, Switzerland and Norway): free shipping, or insured shipping with breakage and theft cover for €4.99;
French overseas departments and territories (DOM-TOM): €70;
Lebanon: €45.90;
Rest of the world: €14.99.
The rate that applies to your delivery address is shown before you confirm your order.
If dispatch is delayed, you will be sent an email informing you of any effect on the delivery time you were given.
In accordance with the law, if delivery is late, you may cancel the order under the conditions and terms set out in article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund it and the shipping costs under the conditions of article L 138-3 of the French Consumer Code.
For deliveries by a carrier, BGD GROUP cannot be held responsible for a delivery delay due solely to the customer’s unavailability after several appointments have been offered.
Article 9: Warranty
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects provided for by articles 1641 et seq. of the French Civil Code. If a product sold does not conform, it may be returned, exchanged or refunded.
All claims, exchange or refund requests must be made by email within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all their parts (accessories, packaging, instructions…). Shipping costs will be refunded on the basis of the rate invoiced, and return costs will be refunded on presentation of receipts.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in article 6.
Article 10: Liability
The products offered comply with the French legislation in force. BGD GROUP cannot be held liable if the legislation of the country where the product is delivered is not complied with. It is your responsibility to check with the local authorities whether the products or services you intend to order may be imported or used.
Furthermore, BGD GROUP cannot be held liable for damage resulting from improper use of the product purchased.
Finally, BGD GROUP cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a service interruption, an outside intrusion or the presence of computer viruses.
Article 11: Applicable law in the event of disputes
The language of this contract is French. These terms of sale are governed by French law. In the event of a dispute, the French courts alone shall have jurisdiction.
Article 12: Intellectual property
All elements of the website https://mon-adaptateur.fr/ are and remain the exclusive intellectual property of BGD GROUP. No one is authorised to reproduce, exploit, redistribute or use in any way whatsoever, even partially, elements of the website, whether software, visual or sound. Any simple link or hyperlink is strictly prohibited without the express written consent of BGD GROUP.
Article 13: Personal data
BGD GROUP reserves the right to collect identifying information and personal data about you. They are necessary to manage your order and to improve the services and information we send you.
They may also be passed on to the companies that contribute to these relationships, such as those responsible for carrying out services and orders, for their management, performance, processing and payment.
This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the French law of 6 January 1978, you have a right of access, rectification and objection regarding the identifying information and personal data concerning you, directly on the website.
Article 14: Archiving and proof
BGD GROUP will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with article 1348 of the French Civil Code.
The computerised records of BGD GROUP will be considered by all parties concerned as proof of the communications, orders, payments and transactions between the parties.
